A new chapter for Outback Astronomy: What the Court decision means for our guests

Summary

Over the past three+ years, many of you have followed our journey as we worked to protect the dark, quiet skies that make Outback Astronomy what it is. Last week, on 25 March 2026, the NSW Land and Environment Court upheld our appeal against the Hydrostor (A‑CAES NSW Pty Ltd) project – the Silver City Energy Storage (SCES) – a decision that brings both relief and a renewed sense of purpose for our family and our business.

This outcome doesn’t stop the SCES project, but it does something incredibly important – it formally recognises the real impacts that noise and light would have on our stargazing experience, and it puts enforceable protections in place for our home and our guests.

What the Court recognised

The Court’s decision acknowledges that:

  • Outback Astronomy is uniquely dependent on natural darkness and quiet.
  • Construction noise and lighting – intended to run 24/7 for 3+ years – needed additional measures to manage any impact on our business and our home.
  • The project sits on the Flying Doctor deposit, where a separate mining approval had quietly lingered in the background. The Court required that approval to be confirmed as lapsed or surrendered before Hydrostor can begin work.

These points matter. They vindicate what we’ve been saying all along – our skies are not just beautiful – they are essential.

What has changed

The amended consent conditions now require Hydrostor to:

  • Consult with us at every major stage
  • Monitor noise and light at our property during construction
  • Report data directly to us
  • Notify us in advance of high‑impact activities
  • Design and operate lighting to Australian standards
  • Demonstrate compliance over the life of the project

These are not gestures. They are obligations – measurable, auditable and enforceable.

  • a road trip overnight stop; and,
  • impressive and immersive tourism story.

What you may not know is that the long legal process to secure these protections came at a significant cost.

Much of the capital we’d set aside for improvements, ongoing renovations and future expansion (including additional staff) was instead redirected into legal and professional fees simply to safeguard the night sky we all share. We don’t regret fighting for it – it was necessary – but it has left us needing to rebuild our momentum.
